This Messaging Service Privacy Policy explains how Stodge Inc. dba Postscript and its subsidiaries and affiliates (hereinafter, "Postscript," "We," "Us," "Our") collects, uses, and shares personal information about you in relation to Our text message marketing program (the "Messaging Service"). For purposes of this Messaging Service Privacy Policy, “personal information” means any information that can be used to identify you directly or indirectly. We provide marketing and promotional content related to our network of participating merchants (“Merchants”) through the Messaging Service. This Messaging Service Privacy Policy is strictly limited to the Messaging Service and does not limit or restrict any other privacy policy(ies) that may govern the relationship between you and Us in other contexts. If you need to access this Messaging Service Privacy Policy in a different form due to a disability, please contact us by sending an email to support@postscriptshoppernetwork.com.

An Important Note: We also provide text message marketing and related services to Merchants. Our processing of Merchant data is governed by the contracts we have in place with Merchants, not this Messaging Service Privacy Policy. When We process personal information in this way, We are acting at the direction of the Merchant, and the Merchant’s respective privacy policies govern their collection and use of personal information. This Messaging Service Privacy Policy does not apply to any of the personal information that our Merchants may collect and process in connection with their own messaging services.

Changes to the Messaging Service Privacy Policy
We may revise this Messaging Service Privacy Policy from time to time in our sole discretion. If there are any material changes to this Messaging Service Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Messaging Service Privacy Policy if you continue to use the Messaging Service after the new Messaging Service Privacy Policy takes effect.

Personal Information We Collect
We collect information that you provide us, information we obtain automatically when you use our Messaging Service, and information from Merchants and other third-party services and organizations, as described below.

  • Sign Up and Contact Information. When you sign up for the Messaging Service, We collect personal information such as your name, phone number, and email address.

  • Use of the Messaging Service. When you use the Messaging Service to send or receive messages, We collect communications metadata (e.g., the time/date a message was sent or received) and the contents of any communications you send or receive via the Messaging Service. 

  • Use of Merchant Services. We collect and receive personal information regarding your interactions with Merchants, such as the Merchants you visit, the products you view and visit, offers you have previously received from a Merchant, your message and order history, and other information you have directly provided to the Merchant.

  • Surveys, Sweepstakes, and Contests. If you participate in a contest, sweepstakes, research study, or email survey associated with the Messaging Service, We will collect basic contact information and any other information you choose to provide in connection with these activities. 

  • Customer Support. We will also collect your personal information if you contact Us with questions about the Messaging Service or for customer service.

  • Device Information. We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location derived from IP address), and Internet service provider.

  • Cookies. We may also collect information about you using cookies or similar technologies on Our website, Merchant websites, or other digital properties. Cookies are small text files placed on device browsers that store preferences and facilitate and enhance your experience. Cookies enable personalization of your experience via the Messaging Service (e.g., sending you personalized text messages based on your browsing activity on a Merchant website).

  • Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in our Services that collects information about engagement on our Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. For example, we may identify whether you make a purchase at a Merchant based on an offer we have provided you. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.

Use of Personal Information
We use your information for a variety of business purposes, as described below.

  • Provide, Improve, and Personalize the Messaging Service: To deliver, analyze, maintain and support the Messaging Service; to enhance the Messaging Service features; and to customize and personalize your experiences on the Messaging Service. For example, we may make product recommendations based on your purchase history with other Merchants, send you reminders or recommendations based on your browsing history with a Merchant, or identify whether you complete a purchase with a Merchant after receiving an offer through the Messaging Service.  

  • Authentication, Integrity, Security, and Safety: To identify and prevent security risks; to prevent fraudulent, deceptive, and malicious activity including harassment and identify theft; and to verify and maintain the safety, quality, and accuracy of the Messaging Service. For example, We may use cookies to prefill your contact information, and to verify that you are authorized to consent to receive marketing messages to your device.

  • Product Research and Development: To develop, test, and improve Postscript services, including troubleshooting our products and services, developing new or improved Postscript services, and analyzing your use of and interactions with Postscript services.

  • Communicate with You: To communicate with you about the Messaging Service, including changes to our policies and terms, and to respond to you when you contact us.

We may use your personal information to generate aggregated and/or de-identified information. Aggregated and/or de-identified information is not personal information and may be shared with any third party, including advertisers, promotional partners, and sponsors.

Sharing of Personal Information
We may share your personal information if you consent to Us doing so, as well as in the following circumstances:

  • Third Parties that Help Provide the Messaging Service. We may share your personal information with third parties that help Us provide the Messaging Service (including, but not limited to, platform providers, phone companies, and other vendors who assist us in the delivery of text messages, fraud prevention, maintaining the security of the Messaging Service, and to verify your device and contact information).

  • Merchants. We may share attribution and reporting data with merchants, including to identify whether you made a purchase at that merchant after receiving an offer from the Messaging Service.

  • Legal Requirements, Disclosures to Protect Us or Others. We may disclose any information We store associated with you to external parties if We, in good faith, believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) protect your, Our, or others' rights, property, or safety; (iii) enforce Our policies or contracts; (iv) collect amounts owed to Us; or (v) assist with an investigation or prosecution of suspected or actual illegal activity.

  • Affiliates. We may share personal information with other companies and brands that We own or control. These companies will use your personal information in the same way as We can under this Messaging Service Privacy Policy.

  • Change of Control. We may transfer any information We collect in the event we sell or transfer all or a portion of our business or assets (including any shares in the company) or any portion or combination of our products, services, businesses and/or assets. Should such a transaction occur (whether a divestiture, merger, acquisition, bankruptcy, dissolution, reorganization, liquidation, change of control or similar transaction or proceeding), we will use reasonable efforts to ensure that any transferred information is treated in a manner consistent with this Privacy Notice.

Accurate Information
When you complete forms online or otherwise provide Us information in connection with the Messaging Service, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in Our sole discretion, We believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Messaging Service for an ulterior purpose, We may refuse you access to the Messaging Service and pursue any appropriate legal remedies.

Choices and Controls
Text messages may be sent via an automatic telephone dialing system. Consent to receive automated marketing text messages is not a condition of any purchase. You can opt-out of receiving further commercial text messages via the Messaging Service by responding to any of Our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. Your Privacy Rights
You may have certain rights to manage your personal information depending on where you live. Depending on your jurisdiction, the following rights may apply, subject to certain exceptions:

  • Access Personal Information about you, including: (i) confirming whether we are processing your personal information; (ii) obtaining access to or a copy of your personal information; or (iii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company (aka the right of data portability);

  • Request Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information; and

  • Request Deletion of your personal information. If required by law, we will grant such a request, but note that in many cases, we must keep your personal information to comply with legal obligations, resolve disputes, enforce agreements, or for other business purposes.

Do Not Track. We do not recognize the “Do Not Track” signal.

Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

By using the Messaging Service or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Messaging Service. If we learn of a security system’s breach, we may attempt to notify you by mail, by sending an email to you, or other reasonable means. 

International Data Transfers
All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We endeavor to safeguard your information consistent with the requirements of applicable laws.

Retention
We store the personal information we receive as described in this Messaging Service Privacy Policy for as long as you use the Messaging Service or as necessary to fulfill the purpose(s) for which it was collected, provide the Messaging Service, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
